These terms and conditions govern your use of the Mapigo application ("App") and any services provided through the App ("Services"). By using the App or Services, you agree to these terms and conditions.
Use of the App and Services
The App and Services are provided solely for your personal, non-commercial use. You may not use the App or Services for any illegal or unauthorized purpose. You agree to comply with all applicable laws and regulations when using the App and Services.
Ownership of Content
You retain ownership of all content that you create and share through the App and Services. However, by using the App and Services, you grant Mapigo a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such content in all formats and distribution channels now known or hereafter devised (including in connection with the App and Mapigo's business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.
Prohibited Conduct
You may not use the App or Services in any manner that could damage, disable, overburden, or impair Mapigo's servers or networks, or interfere with any other party's use and enjoyment of the App or Services. You may not attempt to gain unauthorized access to any portion of the App or Services, or any other systems or networks connected to the App or Services. You may not use any automated means, including robots, crawlers, data mining tools, or the like to download data from the App or Services, unless expressly permitted by Mapigo.
Disclaimer of Warranties
The App and Services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. Mapigo disclaims all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
In no event shall Mapigo be liable to you or any third party for any direct, indirect, incidental, special, punitive, or consequential damages arising out of or in connection with your use of the App or Services, whether based on contract, tort, strict liability, or any other legal theory, even if Mapigo has been advised of the possibility of such damages.
Indemnification
You agree to indemnify, defend, and hold Mapigo harmless from any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the App or Services, or your violation of these terms and conditions.
Termination
Mapigo reserves the right to terminate or suspend your access to the App or Services at any time, without notice, for any reason or no reason, including, without limitation, for any violation of these terms and conditions.
Governing Law and Dispute Resolution
These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Mapigo is based. Any dispute arising out of or in connection with these terms and conditions shall be resolved through binding arbitration in the jurisdiction in which Mapigo is based, in accordance with the rules of the American Arbitration Association.
